1. Acceptance of Terms
By creating an account or using Studio Pro ("the Service", operated at nanostudiopro.com), you agree to these Terms of Service. If you do not agree, do not use the Service.
2. The Service
Studio Pro provides AI-assisted fashion photography tools, including image generation, video generation, scene composition, and integrations with third-party e-commerce platforms. Features may change, be added, or be removed at our discretion.
3. Eligibility and Accounts
You must be at least 16 years old to use the Service. You are responsible for keeping your account credentials secure and for all activity under your account. Notify us immediately of any unauthorized access.
4. Credits, Subscriptions, and Billing
- Generations are paid for with credits. Credits can be purchased outright or included in a subscription plan.
- Subscriptions renew automatically until canceled. You can cancel at any time from the Billing page; cancellation takes effect at the end of the current billing period.
- Purchased credits are non-refundable except where required by applicable law. Subscription fees already charged for the current period are non-refundable.
- We may change pricing with at least 14 days' notice for active subscribers.
5. Acceptable Use
You agree not to use the Service to:
- Generate content that is illegal, infringing, defamatory, sexually explicit involving minors, or that depicts real individuals without their consent in a misleading manner.
- Generate content intended to deceive (e.g. impersonation, election misinformation, fraudulent product claims).
- Reverse engineer, scrape, or attempt to extract the underlying models or training data.
- Resell raw API access or share credentials in violation of your plan.
- Interfere with the Service's operation or attempt to bypass rate limits, credit deductions, or security controls.
We may suspend or terminate accounts that violate these rules.
6. Your Content
You retain ownership of the images and prompts you upload. You grant us a limited license to store, process, and transmit your content solely to operate the Service (including sending it to third-party AI providers as described in our Privacy Policy). You are responsible for having the rights to any content you upload.
7. Generated Content
Subject to your compliance with these Terms, you own the outputs you generate through the Service and may use them for personal or commercial purposes. Because AI models can produce similar outputs for different users, we make no guarantee of uniqueness. You are responsible for verifying that your use of generated content does not infringe third-party rights.
8. Third-Party Services
The Service relies on third parties (including Google Gemini, Kling, Stripe, and Cloudflare). Your use of those features is also subject to their terms. We are not responsible for downtime, errors, or content moderation decisions made by upstream providers.
9. Intellectual Property
Studio Pro, its name, logo, and software are owned by us and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available", without warranties of any kind. We do not guarantee that generations will meet your expectations, that the Service will be uninterrupted, or that outputs will be free of errors or unintended content.
11. Limitation of Liability
To the maximum extent permitted by law, our total liability for any claim related to the Service is limited to the amount you paid us in the twelve months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
12. Indemnification
You agree to indemnify and hold us harmless from claims arising out of your content, your use of the Service, or your violation of these Terms.
13. Termination
You may close your account at any time from Settings. We may suspend or terminate your access if you violate these Terms or if required by law. Sections 6, 7, 9, 10, 11, and 12 survive termination.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be announced via email or in-app notice at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.
15. Governing Law
These Terms are governed by the laws of the jurisdiction in which Studio Pro operates, without regard to conflict-of-laws rules. Disputes will be resolved in the competent courts of that jurisdiction unless otherwise required by applicable consumer protection law.
